The Health Innovation Program (HIP) maintains this Web site for your personal entertainment, information, education and communication. These Terms of Service (“Terms”) govern your access to and use of the HIPxChange website. Your access to and use of the website is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the website. 

We designed the HIPxChange website to be an enjoyable and informative experience for all, so please read our policies regarding use of the site. By using the site you agree to be bound by these Terms. If you cannot agree with these rules, please do not visit our site. If you are using the website on behalf of an organization or entity (“Organization”), then you are agreeing to these Terms on behalf of that Organization and you represent and warrant that you have the authority to bind the Organization to these Terms. In that case, “you” and “your” refers to you and that Organization.

Use of the Site

We will treat any communication, material, ideas, know-how or techniques that you provide to our site as non-confidential and non-proprietary. By providing content to us, you grant us and our affiliates unrestricted use of the material. We may use this material for any purpose, including modification, reproduction, transmission, and posting for internal and commercial use.

The comments, opinions, or statements posted by other users of our site represent their views, not ours. We do not necessarily endorse the information placed online by our visitors and cannot be held responsible for such material.

We have not reviewed all of the Web sites linked to this site, and we cannot be held responsible for the contents of those sites.

Use of Community Areas

Some areas of the website may allow you to post or upload information, text, graphics, or other material (“Content”), and to share your Content with others. You retain ownership of your Content, but there are many things that users may do with your Content; for example, copy it, modify it, re-share it, or broadcast it. The Health Innovation Program has no responsibility for that activity. You understand that publishing your Content on the website is not a substitute for registering it with the U.S. Copyright Office, the Writers Guild of America, or any other rights organization. Please consider carefully what you choose to share.

You are responsible for ensuring that all material, including text, images, and sound, placed by you on our site is original and does not infringe the proprietary rights of anyone else. If you include material that is not yours, you must obtain the owner’s consent before posting and provide due credit. You agree not post Content that (i) may create risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, to any other person, or to any animal; (ii) may create a risk of any other loss or damage to any person or property; (iii) seeks to harm or exploit children by exposing them to inappropriate content, asking for personally identifiable details or otherwise; (iv) may constitute or contribute to a crime or tort; (v) contains any information or content that we deem to be unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, profane, or otherwise objectionable; (vi) contains any information or content that is illegal (including, without limitation, the disclosure of insider information under securities law or of another party’s trade secrets); (vii) contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships; or (viii) contains any information or content that you know is not correct and current. You agree that any Content that you post does not and will not violate rights of any kind, including without limitation any intellectual property rights or rights of privacy. We reserve the right, but are not obligated, to reject and/or remove any Content that we believe, in our sole discretion, violates these provisions.

Please do not place any material on our site that may be considered offensive, obscene, abusive, harassing, hateful, libelous or unlawful. We may monitor discussions, chats, postings and the like from time to time, and we have the right, but not the obligation, to remove, edit or relocate any content that we feel does not live up to the standards we have set for our site. 

Our bulletin boards, chat rooms, and message centers are for discussion and education. Please do not post advertisements or commercial messages. 

We reserve the right at all times, but are not obligated, to remove or refuse to distribute any Content on the website. 

Your Account

You may select a name to use when you register, post messages, or go to a chat room. Please do not use a name that belongs to another person or attempt to masquerade as someone else. You must provide us accurate information when you create your HIPxChange account. We may maintain different types of accounts for different types of users or organizations. You may never use another user’s account without permission. 

You are responsible for safeguarding the password that you use to access the website, and for any activities or actions under your password, whether your password is with HIPxChange or a third-party service. We encourage you to use “strong” passwords that use a combination of upper- and lowercase letters, numbers, and symbols. You agree not to disclose your password to a third party. HIP cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

Our Right to Change or Revise Our Policy. We may revise these rules and policies at any time by updating this posting. Because you agree to follow these rules when you use our site, please visit this page from time to time to review the current rules.

Privacy

We care about the privacy of our users. We collect, use, and share personally identifiable information and non-personally identifiable information as described in our Privacy Policy. You agree that by using the website, you agree to the collection of such information, and to have your personal data collected, used, and transferred to and processed in the United States.

Google Analytics

This website uses Google Analytics to help analyze how users use the site. The tool uses “cookies,” which are text files placed on your computer, to collect standard Internet log information and visitor behavior information in an anonymous form. The information generated by the cookie about your use of the website (including IP address) is transmitted to Google. This information is then used to evaluate visitors’ us of the webiste and to compile statistical reports on website activity for the Health Innovation Program.

We will never (and will not allow any third party to) use the statistical analytics tool to track or to collect any Personally Identifiable Information (PII) of visitors to our site. Google will not associate your IP address with any other data held by Google. Neither we nor Google will link, or seek to link, an IP address with the identity of a computer user. We will not associate any data gathered from this site with any Personally Identifiable Information from any source, unless you explicitly submit that information via a fill-in form on our website.

We respect the intellectual property rights of others, and require that people who use the website do the same.

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide HIP’s Copyright Agent the following information required by the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act, 17 U.S.C. 512:
